A Wayleave is a method of providing rights for a utility company to install and retain cabling, piping and wiring across private land in return for annual payments to the landowner. Standard payments are calculated from base figures agreed with various national land authorities. For underground work and for continuous access, companies usually seek an Easement. An Easement provides similar access rights for the installation and maintenanceof infrastructure equipment, with a one-off payment being granted for permanent access.
Easements can also be entered into between landowners. This involves documenting a legal right for a specific purpose e.g. to have access to land, drainage (septic tank, soak away etc) and water supply.
An Easement can be registered at the Land Registry in order to ensure that future owners of the land adhere to it.
